Docker Network DHCP Pool not working

So I have setup a DCHP pool on the custom network i have called br0.40 which is on VLAN 40

but all new docker images I start are being assigned ip addresses outside of this range, like

even though its configured without a static ip

any ideas please?

    even if I set some fixed ip addresses on some docker containers. Others can steal them
