Is custom kernel distribution allowed?

I'm successfully using a custom compiled kernel with some interesting built-in modules, like:

 

tun/tap driver module;

802.1d ethernet bridging;

AMD K8 Powernow driver.

 

Can I distribute the compiled custom kernel to other users?

 

I know that Linux kernel is GNU opensource as the modified md module, but I don't want to cause any trouble to Tom or to the unRAID community offering an "unsupported" kernel - even if this is the same kernel with extra modules - without explicit permission.

I have never seen a direct statement of support or against.

BubbaQ released a modified unRAID as BubbaRaid with a number of enhancements.

It was met with great success and I do not believe there were any complaints about it.
